NOTICE OF HEARING

This serves as formal notice of a hearing to address in an open court the code violations located at 3404 Dixie Farm Road, Pearland, Texas 77581, Brazoria CAD Property ID: 218956 and formally recognized as Jenkins (A0070 W D C Hall)(Pearland), Lot 15A1. [Please note: this property has been referenced in some documents as 3406 Dixie Farm Road.] The court date has been scheduled at 2:00 p.m. on June 19, 2018, at the Pearland Municipal Court, located at 2555 Cullen Parkway, Pearland, Texas 77581.

The City of Pearland Assistant Building Official inspected the property on March 7, 2018, and generated an Inspection Report. The Assistant Building Official found the structures at 3404 Dixie Farm Road to be substandard based upon violations of the minimum standards adopted under the Pearland Code of Ordinances and the International Property Maintenance Code. Specifically, the violations include:

1. City of Pearland Ordinance 7-61.2(1) – The property contains a building with roof, ceiling, floors, sills, or foundations, or any combination thereof, rotted or decayed and falling apart, windows out, uninhabitable, and untenantable, due to obsolescence and deterioration caused by neglect or vandalism or old age or the elements.
2. City of Pearland Ordinance 7-61.2(3) – The property contains a building which is a fire menace, to wit, by being in a dilapidated condition, and which has an accumulation of rubbish, vegetation, and solid waste which is likely to become a fire, or be set on fire, in and around said building and endanger the person or property of others.
3. Int’l Prop. Maint. Code 108.1.1 – The property contains an unsafe structure that is dangerous to the life, health, property, or safety of the public or the occupants of the structure because such structure is damaged, decayed, dilapidated, structurally unsafe, or of such faulty construction or unstable foundation, that partial or complete collapse is possible.
4. Int’l Prop. Maint. Code 108.1.3 – The property contains a structure that is unfit for human occupancy because the code official found that the structure is unsafe, unlawful, or because of the degree to which the structure is in disrepair or lacks maintenance, is unsanitary, vermin or rat infested, contains filth and contamination, or lacks ventilation, illumination, sanitary or heating facilities, or other essential equipment required by the code.
5. Int’l Prop. Maint. Code 108.1.5– Any structure or premises that has any…of the conditions or defects described below shall be considered dangerous:
a. (3) Any portion of a building, structure or appurtenance that has been damaged by fire, earthquake, wind, flood, deterioration, neglect, abandonment, vandalism or by any other cause to such an extent that it is likely to partially or completely collapse, or to become detached or dislodged.
b. (9) A building or structure, used or intended to be used for dwelling purposes, because of inadequate mantenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, ventilation, mechanical or plumbing system, or otherwise, is determined by the code official to be unsanitary, unfit for human habitation or in such a condition that is likely to cause sickness or disease.
6. Int’l Prop. Maint. Code 302.5 – All structures and exterior property shall be kept free from rodent harborage and infestation. Where rodents are found, they shall be promptly exterminated by approved processes which will not be injurious to human health. After pest elimination, proper precautions shall be taken to eliminate rodent harborage and prevent reinfestation.
7. Int’l Prop. Maint. Code 302.7 – The property contains accessory structures, including detached garage, fences, and walls, that are not maintained structurally sound and in good repair as required.
8. Int’l Prop. Maint. Code 304.1 – The property contains a structure, the exterior of which is not maintained in good repair, structurally sound, and sanitary, such that it poses a threat to the public health, safety, and welfare.
9. Int’l Prop. Maint. Code 304.4 – The property contains a structure including structural members that are not being maintained free from deterioration, and therefore are not capable of safely supporting the imposed dead and live loads.
10. Int’l Prop. Maint. Code 304.13 – The property contains a building with windows, doors, and frames that are not kept in sound condition, good repair, or weather tight.
11. Int’l Prop. Maint. Code 308.1 – The exterior property and premises, and the interior of the structure, are not free from accumulation of rubbish or garbage as required.
12. Int’l Fire Code 311.1.1 – Buildings, structures, and premises…which persistently or repeatedly become unprotected or unsecure, which has been occupied by unauthorized person for illegal purposes, or which present a danger of structural collapse or fire spread to adjacent properties shall be considered abandoned, declared unsafe and abated by demolition or rehabilitation in accordance with the Int’l Prop. Maint. Code and the Int’l. Building Code.

These violations cause the building to be considered dilapidated, substandard, and/or unfit for human habitation and pose a hazard to the public health, safety, and welfare of the community.

The scheduled court date described above is for a public hearing to determine the actions that must be taken by you and/or the City regarding the vacation, securing, repair, removal, or demolition of a substandard building located on the property listed above. The hearing will be before the Municipal Court Judge. At the hearing, the owner, lienholder, and/or mortgagee will be given the opportunity to comment, testify, or present witnesses or written information about any matter relating to the substandard building. At the hearing, the City shall have the burden of proving by a preponderance of the evidence that the building is substandard as described in Pearland City Ordinance 7-61.2. The owner, lienholder, or mortgagee shall have the burden of proof to demonstrate the scope of any work that may be required to comply with City Ordinances, and the time it will take to reasonably perform the work.

According to the real property records of Brazoria County, Texas, and appropriate records of the Secretary of State, Central Appraisal District, tax rolls, etc., Assan Tran is an owner, lienholder, or mortgagee of the real property described in this notice. If you no longer own or have an interest in the property, please notify the office of the City Attorney on or before the hearing date.

APPLICATION. City of Pearland, 3519 Liberty Drive, Pearland, Texas 77581, has applied to the Texas Commission on Environmental Quality (TCEQ) to amend Texas Pollutant Discharge Elimination System (TPDES) Permit No. WQ0010134007 (EPA I.D. No. TX0116581) to authorize an increase in the discharge of treated wastewater to a volume not to exceed an annual average flow of 8,000,000 gallons per day. The domestic wastewater treatment facility is located at 5900 Magnolia Street, Pearland, in Brazoria County, Texas 77584. The discharge route is from the plant site to Mary’s Creek; thence to Clear Creek Above Tidal. TCEQ received this application on March 1, 2018. ADDITIONAL NOTICE. TCEQ’s Executive Director has determined the application is administratively complete and will conduct a technical review of the application. After technical review of the application is complete, the Executive Director may prepare a draft permit and will issue a preliminary decision on the application. Notice of the Application and Preliminary Decision will be published and mailed to those who are on the county-wide mailing list and to those who are on the mailing list for this application. That notice will contain the deadline for submitting public comments.

PUBLIC COMMENT / PUBLIC MEETING. You may submit public comments or request a public meeting on this application. The purpose of a public meeting is to provide the opportunity to submit comments or to ask questions about the application. TCEQ will hold a public meeting if the Executive Director determines that there is a significant degree of public interest in the application or if requested by a local legislator. A public meeting is not a contested case hearing.

OPPORTUNITY FOR A CONTESTED CASE HEARING. After the deadline for submitting public comments, the Executive Director will consider all timely comments and prepare a response to all relevant and material, or significant public comments. Unless the application is directly referred for a contested case hearing, the response to comments, and the Executive Director’s decision on the application, will be mailed to everyone who submitted public comments and to those persons who are on the mailing list for this application. If comments are received, the mailing will also provide instructions for requesting reconsideration of the Executive Director’s decision and for requesting a contested case hearing. A contested case hearing is a legal proceeding similar to a civil trial in state district court.

TO REQUEST A CONTESTED CASE HEARING, YOU MUST INCLUDE THE FOLLOWING ITEMS IN YOUR REQUEST: your name, address, phone number; applicant’s name and proposed permit number; the location and distance of your property/activities relative to the proposed facility; a specific description of how you would be adversely affected by the facility in a way not common to the general public; a list of all disputed issues of fact that you submit during the comment period and, the statement “[I/we] request a contested case hearing.” If the request for contested case hearing is filed on behalf of a group or association, the request must designate the group’s representative for receiving future correspondence; identify by name and physical address an individual member of the group who would be adversely affected by the proposed facility or activity; provide the information discussed above regarding the affected member’s location and distance from the facility or activity; explain how and why the member would be affected; and explain how the interests the group seeks to protect are relevant to the group’s purpose.

Following the close of all applicable comment and request periods, the Executive Director will forward the application and any requests for reconsideration or for a contested case hearing to the TCEQ Commissioners for their consideration at a scheduled Commission meeting.

The Commission may only grant a request for a contested case hearing on issues the requestor submitted in their timely comments that were not subsequently withdrawn. If a hearing is granted, the subject of a hearing will be limited to disputed issues of fact or mixed questions of fact and law relating to relevant and material water quality concerns submitted during the comment period.
