The project consists of the pre-construction services and construction of a new state of the art fire station of between 16,000 and 18,000 square feet intended to house two 4 person engine crews, one 4 person ladder crew, one 2 person ambulance crew and their apparatus. The facility will be constructed to operate full staff on a 24/7 basis. The project will be located along the north side of Shadow Creek Parkway (FM2234) approximately 500 feet west of Reflection Bay on a 3.2 acre tract of previously undeveloped property. The station will include dorm rooms, restrooms and showers, a kitchen dining area, a day room, two offices for officers, an exercise room an EMS decontamination room and medical supply storage, storage areas for equipment and bunker gear. The facility will contain four 80 foot deep drive through apparatus bays and the site will include secure parking for all on duty staff as well as limited number of visitor parking. The structural envelop will be designed to 140 mph 3 second gust criteria for wind loads. The project is currently approaching 60% “Design Development” stage under contract with Joiner Architects.

A Mandatory Pre-Proposal Meeting will be held at the City of Pearland, City Hall Annex, 3523 Liberty Drive, Pearland, Texas in the Houston Conference Room at 3:00 p.m. on Thursday, September 6, 2018. This meeting is a mandatory Pre-Proposal Meeting. Attendance at this meeting is a requirement for successful submittal of a proposal for this project.

NOTICE OF HEARING

This serves as formal notice of a hearing to address in an open court the code violations located at 16618 County Road 831, Pearland, Brazoria County, Texas 77584, Brazoria CAD Property ID: 177859 and formally recognized as A0549 H T & B R R Tract 31D (G C Smith). The court date has been scheduled at 2:00 p.m. on September 18, 2018, at the Pearland Municipal Court, located at 2555 Cullen Parkway, Pearland, Texas 77581.

The City of Pearland Assistant Building Official inspected the property on June 27, 2018, and generated an Inspection Report. The Assistant Building Official found the structures at 16618 CR 831 to be substandard based upon violations of the minimum standards adopted under the Pearland Code of Ordinances and the International Property Maintenance Code. Specifically, the violations include:

1. City of Pearland Ordinance 7-61.2(1) – The property contains a building with roof, ceiling, floors, sills, or foundations, or any combination thereof, rotted or
decayed and falling apart, windows out, uninhabitable, and untenantable, due to obsolescence and deterioration caused by neglect or vandalism or old
age or the elements.
2. City of Pearland Ordinance 7-61.2(3) – The property contains a building which is a fire menace, to wit, by being in a dilapidated condition, and which has
an accumulation of rubbish, vegetation, and solid waste which is likely to become a fire, or be set on fire, in and around said building and endanger the
person or property of others.
3. Int’l Prop. Maint. Code 108.1.1 – The property contains an unsafe structure that is dangerous to the life, health, property, or safety of the public or the
occupants of the structure because such structure is damaged, decayed, dilapidated, structurally unsafe, or of such faulty construction or unstable
foundation, that partial or complete collapse is possible.
4. Int’l Prop. Maint. Code 108.1.3 – The property contains a structure that is unfit for human occupancy because the code official found that the structure is unsafe,
unlawful, or because of the degree to which the structure is in disrepair or lacks maintenance, is unsanitary, vermin or rat infested, contains filth and
contamination, or lacks ventilation, illumination, sanitary or heating facilities, or other essential equipment required by the code.
5. Int’l Prop. Maint. Code 302.5 – All structures and exterior property shall be kept free from rodent harborage and infestation. Where rodents are found, they
shall be promptly exterminated by approved processes which will not be injurious to human health. After pest elimination, proper precautions shall be taken
to eliminate rodent harborage and prevent reinfestation.
6. Int’l Prop. Maint. Code 304.1 – The property contains a structure, the exterior of which is not maintained in good repair, structurally sound, and sanitary, such
that it poses a threat to the public health, safety, and welfare.
7. Int’l Prop. Maint. Code 304.2 – The property contains a building on which exterior surfaces, including but not limited to, doors, door and window frames,
cornices, porches, and trim are not maintained in good condition, and siding and masonry joints, as well as those between the building envelope and
the perimeter of windows, doors and skylights, are not maintained weather resistant and water tight.
8. Int’l Prop. Maint. Code 304.4 – The property contains a structure including structural members that are not being maintained free from deterioration, and
therefore are not capable of safely supporting the imposed dead and live loads.
9. Int’l Prop. Maint. Code 304.6 – The property contains a building on which exterior walls are not free from holes, breaks, or loose or rotting materials; or is not
maintained weatherproof and property surface coated where required to prevent deterioration.
10. Int’l Prop. Maint. Code 304.7 – The property contains a building on which roof and flashing are not sound, tight, or have defects that admit rain, or on which
roof drainage is not adequate to prevent dampness or deterioration in the walls or interior portions of the structure.
11. Int’l Prop. Maint. Code 304.13 – The property contains a building with windows, doors, and frames that are not kept in sound condition, good repair, or
weather tight.
12. Int’l Prop. Maint. Code 304.15 – The property contains a building on which exterior doors, door assemblies, and hardware are not being maintained in
good condition and on which locks at entrances do not tightly secure the doors.
13. Int’l Fire Code 311.1.1 – Buildings, structures, and premises…which persistently or repeatedly become unprotected or unsecure, which has been occu
pied by unauthorized person for illegal purposes, or which present a danger of structural collapse or fire spread to adjacent properties shall be consid
ered abandoned, declared unsafe and abated by demolition or rehabilitation in accordance with the Int’l Prop. Maint. Code and the Int’l. Building Code.

These violations cause the building to be considered dilapidated, substandard, and/or unfit for human habitation and pose a hazard to the public health, safety, and welfare of the community.

The scheduled court date described above is for a public hearing to determine the actions that must be taken by you and/or the City regarding the vacation, securing, repair, removal, or demolition of a substandard building located on the property listed above. The hearing will be before the Municipal Court Judge. At the hearing, the owner, lienholder, and/or mortgagee will be given the opportunity to comment, testify, or present witnesses or written information about any matter relating to the substandard building. At the hearing, the City shall have the burden of proving by a preponderance of the evidence that the building is substandard as described in Pearland City Ordinance 7-61.2. The owner, lienholder, or mortgagee shall have the burden of proof to demonstrate the scope of any work that may be required to comply with City Ordinances, and the time it will take to reasonably perform the work.

According to the real property records of Brazoria County, Texas, and appropriate records of the Secretary of State, Central Appraisal District, tax rolls, etc., C. A. Stevens is an owner, lienholder, or mortgagee of the real property described in this notice. If you no longer own or have an interest in the property, please notify the office of the City Attorney on or before the hearing date.

The City of Pearland requires the Supervisory Control and Data Acquisition (SCADA) design/upgrade and repair for the Water Production, Wastewater Treatment, and Lift Stations facilities.
