NOTICE OF PUBLIC HEARING ON PETITION FOR ANNEXATION OF LAND INTO BRAZORIA COUNTY MUNICIPAL UTILITY DISTRICT NO. 42

The Board of Directors of Brazoria County Municipal Utility District No. 42 (the “District”) will hold a hearing, open to the public, on Monday, January 7, 2019, at 11:00 a.m. at the offices of Allen Boone Humphries Robinson LLP, 3200 Southwest Freeway, Suite 2600, Houston, Texas 77027, for the purpose of considering a petition requesting the annexation of land to the District. The Board of Directors of the District will hear all interested persons and consider the evidence. All interested persons, including property owners within the District, will be afforded reasonable opportunity to be heard for or against the addition of land to the District. The land proposed for annexation is described as follows:

BEING a 1.626 acre (70,841 square foot) tract of land situated in the H.T. & B.R.R. Co. Survey, Section 71, Abstract 291, City of Manvel, Brazoria County, Texas and being all of a called 0.9009 of one acre tract of land as described in an instrument to 72 Acres on 288, Ltd. recorded under Brazoria County Clerk’s File Number (B.C.C.F. No.) 2018034948 and a portion of Lot 31, Lot 32 and a 40 foot Unimproved Road of EMIGRATION LAND COMPANY SUBDIVISION SECTION 71, a subdivision per plat recorded under Volume 2, Page 81-82 of the Brazoria County Plat Records, said 1.626 acre of land being more particularly described as follows:

BEGINNING at a 1/2-inch iron pipe with cap stamped “Brown & Gay” found for the common west corner of a called 6.32 acre tract of land as described in an instrument to Manvel Town Center, Ltd. recorded under B.C.C.F. No. 2007004251 and a called 10.3214 acre tract of land described as Tract Two in an instrument to New Rodeo 288, Ltd. recorded under B.C.C.F. No. 2006043836, being the common west corner of Lot 35 and Lot 36 of said EMIGRATION LAND COMPANY SUBDIVISION, same being on the east line of said 40 foot Unimproved Road and being the northeast corner of the herein described tract;

THENCE, S 03°2l’02” E, along the east line of said Unimproved Road and the west line of Lot 36, Lot 37 of said EMIGRATION LAND COMPANY SUBDIVISION SECTION 71, said 6.32 acre tract, a called 4.00 acre tract of land as described in an instrument to Manvel Town Center, Ltd. recorded under B.C.C.F. No. 2007004251 and a called 3.522799 acre tract of land as described in an instrument to Manvel Town Center, Ltd. recorded under B.C.C.F. No. 2007004252, a distance of 798.43 feet to a 1/2-inch iron pipe with cap stamped “Brown & Gay” found for the southwest corner of said 3.522799 acre tract, being on the north right-of-way line of State Highway 6 (200 foot width) recorded under B.C.C.F. Nos. 94-000272, 94-014296, 94-014297, 94-037011, 95-001320, 95-038346, 96-005004 and being the southeast corner of the herein described tract;

THENCE, N 70°29’05” W, along the north right-of-way line of said State Highway 6, at a distance of 43.41 feet pass the southeast corner of said 0.9009 of one acre tract and continuing along the south line of said 0.9009 of one acre tract for a total distance of 188.56 feet to the southwest corner of said 0.9009 of one acre tract and the herein described tract;

THENCE, along the westerly lines of said 0.9009 of one acre tract, the following courses and distances:

N 64°30’55” E, a distance of 28.28 feet to a point for corner;

N 19°30’55” E, a distance of 119.21 feet to the beginning of a tangent curve to the left;

In a Northerly direction, along said curve to the left, a distance of 107.75 feet, having a radius of 270.00 feet, a central angle of 22°51‘57” and a chord which bears N 08°04’57” E, 107.04 feet to the point of tangency;

N 03°21‘02” W, a distance of 499. 75 feet to the common line of Lot 30 and Lot 31 of said EMIGRATION LAND COMPANY SUBDIVISION, being the northwest of said 0.9009 of one acre tract and the herein described tract;

THENCE, N 86°38’58” E, along the common line of said Lot 30 and said Lot 31 and the north line of said 0.9009 of one acre tract, at a distance of 40.00 feet pass the common east corner of said Lot 30 and said Lot 31, being the northeast corner of said 0.9009 of one acre tract and being the west line of said Unimproved Road and continuing over and across said Unimproved Road for a total distance of 80.00 feet to the POINT OF BEGINNING and containing 1.626 acres (70,841 square feet) of land.

Bearing orientation is based on the Texas Coordinate System of 1983 (NAD83), South Central Zone 4204 and is referenced to monuments found along the east right-of-way line of 40 foot Unimproved Road as cited herein.

ORDINANCE NO. 1570

An Ordinance of the City Council of the City of Pearland amending Chapter 30, Utilities, of the City Code of Ordinances by adding Article VI, Illicit Discharge Prohibitions; establishing illicit discharge regulations as required by U.S. Environmental Protection Agency guidelines and standards adopted by the Texas Commission on Environmental Quality; having a savings clause, a severability clause, a penalty clause and a repealer clause; providing for publication, codification, and an effective date.

Section 2. Penalty. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than Five Hundred Dollars.
