ORDINANCE NO. 1330-1

An ordinance of the City Council of the City of Pearland, Texas amending Chapter 20, Offenses and Miscellaneous Provisions, Section 20-9 Smoking in Public Places, of the City of Pearland Code of Ordinances; having a savings clause, a severability clause, and a repealer clause; and providing for codification and an effective date.

Violation and penalties.

(1) A person who violates the provisions of this ordinance commits a Class C misdemeanor, punishable by a fine not to exceed $2,000. A culpable mental state is not required for a violation of this ordinance, and need not be proved.

(2) A person who owns, manages, operates, or otherwise controls a public place or workplace and who fails to comply with the provisions of this ordinance shall be guilty of an infraction, punishable by:

a. A fine not exceeding two hundred dollars ($200) for a first violation.

b. A fine not exceeding four hundred dollars ($400) for a second violation within a period of twelve (12) consecutive months.

c. A fine not exceeding five hundred dollars ($500) for each additional violation within a period of twelve (12) consecutive months.

(3) The City Manager may suspend or revoke a permit or license issued to the operator of a public place or workplace where a violation of this ordinance occurs.

(4) Each day an offense occurs is a separate violation.

(5) Violation of this ordinance is hereby declared to be a public nuisance, which may be abated by the Director of Health by restraining order, preliminary and permanent injunction, or other means provided for by law, and the City may take action to recover the costs of the nuisance abatement.

On November 25, 2019, at 6:30 p.m., the City Council of the City of Pearland, Texas, will hold a public hearing to consider the Fifth Amendment to the Reinvestment Zone Project and Financing Plan (the “Plan”) to: (i) increase the amount of bonded indebtedness to be incurred, (ii) increase the total estimated project costs, and (iii) make any other necessary related changes to the Plan. NOTICE OF PUBLIC MEETING

On December 16th, 2019 at 6:00 pm, the City of Pearland will conduct a public meeting to provide an opportunity for public comments on the City’s new Surface Water Treatment Plant (SWTP) transmission pipelines and the accompany draft Environmental Information Document (EID), at the Pearland City Hall Annex, 3521 Liberty Drive, Pearland, Texas 77581. The purpose of the meeting will be to discuss the EID, which was prepared to best plan, manage, and respond to any environmental impacts that might occur in relation with the proposed Project.

The City of Pearland has authorized the proposed SWTP project to meet the future demand of potable water for the growing population of the City. The proposed SWTP transmission pipelines will be constructed along existing road right-of-ways in Segments. The first, Segment 2.1, is approximately 7,700 linear feet travelling from the SWTP north along Airline Rd. (CR48) to the intersection of Broadway St. and Airline Rd. Segment 3.1 is approximately 6,500 linear feet traveling east from Segment 2.1 along Broadway Dr. with a turn South along an access easement near Shadow Creek High School and connects to the back of the Kirby Water Plant (WP). Segment 4.1 is approximately 8,000 linear feet traveling west from Segment 2.1 along Broadway Drive to a connection point at the intersection of Broadway Street and FM 521. The Shadow Creek Ranch Extension is an estimated 1,600 linear feet and travels from 3,500-feet South of Shadow Creek Pkwy to Shadow Creek Ranch Water Plant. The proposed project would not increase the base flood elevation and will not violate applicable floodplain regulations or ordinances. Water from the Gulf Coast Water Authority’s (GCWA) American Canal will be purified and treated for distribution throughout the City’s water system providing an additional 10 million gallons of safe, clean water per day to residents of the City of Pearland. It is anticipated that water sewer rates will increase by City Ordinance to cover the growing cost to provide these services and pay for the new surface water program.

The EID was drafted to meet the requirement of Title 30 of the Texas Administrative Code, Chapter 371 (30 TAC §371) of the Texas Water Development Board’s rules for projects financed through the Drinking Water State Revolving Fund (DWSRF) and also to satisfy the requirements of the National Environmental Policy Act (NEPA). The EID was developed in conjunction with the City of Pearland and the Texas Water Development Board (TWDB) application for funding assistance and outlines potential environmental impacts from the proposed project.

The proposed Project has received financing of $159,000,000.00 from the TWDB Drinking Water State Revolving Fund (DWSRF) program. The City of Pearland is seeking public input about the EID prior to its final review by designated regulatory agencies and adoption by the TWDB. The City of Pearland is holding the community meeting to allow a forum for the public to provide discussion and comment on the Project.

One of the purposes of this meeting is to discuss the potential environmental impacts of the project and any alternatives to it. A copy of the draft EID is available for public review at the City Secretary’s Office at 3519 Liberty Drive, Pearland, Texas 77581.
