Consolidated Annual Performance and Evaluation Report

Public Review Period

Outcomes of the City of Pearland’s Community Development Block Grant (CDBG) Program are available for review, via the City’s Consolidated Annual Performance and Evaluation Report (CAPER) for PY 2018. Residents, public agencies and other interested parties can request details from this report, which will be submitted to the U.S. Department of Housing & Urban Development on December 29, 2019. The CAPER will be available via the Administration Department, located at 3519 Liberty Drive, Pearland TX 77581.  Persons may contact Joel Hardy about this report any time during normal operating hours through December 27, 2019. Otherwise, an email with written comments can be submitted to Mr. Hardy at [email protected] by close of business on the 29th of December.

Staff can be available at the Administration Department for translation purposes and to read the CAPER to the visually impaired.  Individuals with visual or other communications impairments should notify the Administration Department at 281-652-1795 two days (48 hours) in advance to ensure assistance will be available in reading the document.

Any person wishing to mail written comments regarding the PY 2018 CAPER should submit them to:

ORDINANCE NO. 91-28

AN ORDINANCE AMENDING THE FRIENDSWOOD CITY CODE BY STRIKING ALL OF SUBSECTION (a) OF SECTION 12-1 OF CHAPTER 12 THEREOF AND SUBSTITUTING THEREFOR A NEW SUBSECTION (a) OF SECTION 12-1; PROVIDING IT UNLAWFUL TO DISCHARGE ANY GUN, PISTOL, OR OTHER FIREARM OR ANY AIR RIFLE OR AIR PISTOL WITHIN THE CORPORATE BOUNDARIES OF THE CITY; PROVIDING EXCEPTIONS; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILITY.

A. It shall be unlawful for any person to discharge any gun, pistol, or other firearm, or other firearm, or any air rifle or air pistol, of any description, within the corporate boundaries of the City. This section shall not be construed to prohibit an officer of the law from discharging a firearm in the performance of his duty nor to any citizen from discharging a firearm when lawfully defending persons or property. Provided, further, the above provisions of this section shall not be applicable to the discharge of firearms at bona fide gun clubs lawfully operating pursuant to the zoning ordinance of the City.

B. Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed $1,000. Each day of violation shall constitute a separate offense.

ORDINANCE NO. 81-12

AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 7 OF THE FRIENDSWOOD CITY CODE BY STRIKING THEREFROM ALL OF SECTION 7-50 AND 7-51 THEREOF AND SUBSTITUTING A NEW SECTION 7-52; PROVIDING IT UNLAWFUL FOR ANY PERSON TO POSSESS FIREWORKS WITHIN THE CITY LIMITS OF THE CITY OF FRIENDSWOOD OR WITHIN 5000 FEET OF THE CORPORATE BOUNDARIES OF THE CITY; DECLARING THE PRESENCE OF FIREWORKS WITHIN THE CITY OR WITHIN 5000 FEET OF THE CORPORATE BOUNDARIES OF THE CITY TO BE A PUBLIC NUISANCE; AUTHORIZING THE SEIZURE OF FIREWORKS FOUND IN VIOLATION OF THIS ORDINANCE; AUTHORIZING THE CITY ATTORNEY TO SEEK INJUNCTIVE RELIEF TO PREVENT UNLAWFUL STORAGE, TRANSPORTATION, KEEPING OR USE OF FIREWORKS WITHIN SUCH AREA; PROVIDING EXCEPTIONS; AND PROVIDING A PENALTY OF NOT LESS THAN $25.00 NOR MORE THAN $200.00 FOR EACH OFFENSE, PROVIDING THAT IF FIREWORKS ARE SEPARATELY WRAPPED OR PACKAGED THE COMMISSION OR OMISSION OF ANY ACT PROHIBITED BY THIS ORDINANCE SHALL CONSTITUTE A SEPARATE OFFENSE AS TO EACH SUCH SEPARATELY WRAPPED OR PACKAGED FIREWORKS, AND PROVIDING THAT EACH DAY OF VIOLATION WITH RESPECT TO EACH SEPARATELY WRAPPED OR PACKAGED FIREWORKS SHALL CONSTITUTE A SEPARATE OFFENSE.

A. The presence of any fireworks within the City of Friendswood and within the area immediately adjacent and contiguous to the city limits of such city extending for a distance outside of such city limits for a total of 5,000 feet, in violation of this Chapter, is hereby declared to be a common and public nuisance.  The Fire Marshall is directed and required to seize any fireworks found in violation of this Chapter and any authorized deputy of the Fire Marshall, or any Police Officer of the City or any other duly constituted Texas Peace Officer is empowered to stop the transportation of and detain any fireworks being transported illegally or to close any building where any fireworks are found stored illegally until the Fire Marshall can be notified in order that such fireworks may be seized in accordance with the terms of this Chapter. Notwithstanding any penal provision of this Chapter, the City Attorney is authorized to file suit on behalf of the City, the Fire Marshall, or both, for such injunctive relief as may be necessary to prevent unlawful storage, transportation, keeping or use of fireworks within the City or such 5,000 feet area.  It shall not be necessary to obtain injunctive relief as a prerequisite to seizure of fireworks. This Ordinance shall not apply within any portion of such 5,000 feet area which is contained within the territory of any other incorporated city, town, or village.

B. Any person who shall manufacture, assemble, store, or possess fireworks in violation of this chapter shall, upon conviction, be fined not less than twenty-five dollars ($25.00) nor more than two hundred dollars ($200.00) for each offense. If fireworks are separately wrapped or packaged, the commission or omission of any act prohibited by this Chapter shall be a separate offense as to each such separately wrapped or separately packaged fireworks. Each day of violation shall constitute a separate offense.

A. It shall be unlawful for any Minor to knowingly remain, walk, run, or stand, or operate or ride in any motor vehicle or on any bicycle, in or upon any Public Place or on the premises of any Establishment within the City during Curfew Hours.

B. It shall be unlawful for the Parent or Guardian of a Minor to knowingly permit or, by insufficient control, allow a Minor to remain in or upon any Public Place or on the premises of any Establishment within the City during Curfew Hours.

C. It shall be unlawful for the owner, Operator, or any employee of an Establishment to knowingly allow a Minor to remain upon the premises of an Establishment during Curfew Hours.

D. A person who violates any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $500.00.  Each day of violation shall constitute a separate offense.
