C. It shall be unlawful to fail to include a label listing each active ingredient of all herbal incense offered for sale to the public.

It shall be unlawful for any peddler, solicitor, canvasser or itinerant vendor to conduct business or related activities in the City, without a valid registration certificate; without a valid identification card; without visibly displaying the identification card that was issued; altering a registration certificate or identification card or with an expired certificate.

B. It shall be unlawful to conduct a business different than described in registration statement; to provide false information, to use a vehicle not identified, to conduct business in a location not listed; to sell or take orders for goods or services not listed in registration.

C. It shall be unlawful to sell or transfer a registration certificate or identification card, to conduct business hours other than those permitted or to conduct business on any public property within the City without written authorization of the City.

D. Penalty not to exceed $200.

AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS, AMENDING THE CITY’S CODE OF ORDINANCES BY REPEALING CHAPTER 54 ARTICLE V “ALARM SYSTEMS” IN ITS ENTIRETY AND REPLACING THE SAME WITH NEW PROVISIONS FOR ALARM SYSTEMS; PROVIDING FOR REQUIREMENTS FOR ALARM SYSTEM PERMITS; PROVIDING FOR THE SUSPENSION OF ALARM PERMITS IN CERTAIN INSTANCES; PROVIDING FOR THE DUTIES OF ALARM SYSTEM COMPANIES; PROVIDING A SAVINGS CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING FOR A PENALTY OR FINE FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE.

A. It shall be unlawful for an alarm user to operate an alarm system without a valid alarm permit and paying a permit fee of $36 of $36 or $72.

B. It shall be unlawful for the alarm user, the alarm installation and the monitoring company to fail to comply with their duties described in this Ordinance.

C. Penalties – Fines for false alarms range from $50, $75 and $100 per alarm, based on the frequency; fine for monitoring company failure to verify is $100 per incident; fine for false statement by alarm company employee is $200 per incident; fine for use of non-permitted alarm system is $100 per incident; fine for use of alarm system during permit suspension is $200 per incident; fine for alarm installation company and monitoring company failing to comply with their duties is $200 per incident.

Construction Manager at Risk

for Barry Rose Water Reclamation Facility (WRF) Expansion

The project entails the performance of Construction Manager at Risk (CMAR) for Pre-Construction Services associated with the final design potentially leading to performance of Construction Phase Services for the construction of City of Pearland’s expansion from 3.1 MGD to 8.5 MGD at the Barry Rose WRF. The project site is located at 1902 Barry Rose Road, Pearland, TX 77581.  This expansion is planned to utilize membrane bio-reactors as the primary treatment technology. The overall project also includes the decommissioning of the 2 MGD Longwood WRF, construction of a transfer lift station at the Longwood site and approximately 25,000 linear feet of forcemain to the expanded Barry Rose WRF.  The Longwood site is located at 2727 Dixie Farm Road, Pearland, TX 77581.

A Mandatory Pre-Proposal Meeting will be held at the City of Pearland City Hall, 3519 Liberty Drive, Pearland, Texas 77581 in the City Council Chambers at 2:00 p.m. on Thursday, January 30, 2020. Attendance of this meeting is a requirement for submitting a qualified proposal for this project. A site visit will be conducted following the Pre-Proposal Meeting.

Each Proposer is required to submit a Qualifications Packet and a Cost Proposal separately. The Qualifications Packet and Cost Proposal should be submitted via the City’s E-bid System located on the City’s website at: https://pearland.ion-wave.net/Login.aspx. All interested Proposers are advised to register as a “supplier” on the City’s E-Bid System at the above website by clicking on “Supplier Registration” and completing a short registration questionnaire. Electronic Proposal Documents and Forms are available for download after registration is approved by City Purchasing office.  No plan fees or deposits are required for proposal documents obtained through the City’s E-Bid System. Questions regarding electronic bidding should be directed to City Purchasing Department at ebids@pearlandtx.gov.

Proposers should note that, while they may respond to this and other Requests for Proposals for similar services regarding the Expansion of the John Hargrove WRF, only one project will be awarded to any one firm and that proposals should be tailored to the project that best fits the Proposer’s qualifications and experience.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS BY DELETING THE DEFINITION OF NONCOMMERCIAL OR NONPROFIT PURPOSE OR CAUSE CONTAINED IN SECTION 18-76 THEREOF; BY ADDING A DEFINITION OF RELIGIOUS, CIVIC, OR CHARITABLE SOLICITATIONS TO SECTION 18-76 THEREOF; BY DELETING THE EXEMPTION FOR MINORS CONDUCTING FUNDRAISING ACTIVITIES FROM SECTION 18-77 (c) THEREOF; BY AMENDING SECTION 18-77 (d) THEREOF TO EXEMPT PERSONS CONDUCTING RELIGIOUS, CIVIC, OR CHARITABLE SOLICITATIONS; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH VIOLATION OF ANY PROVISION HEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; AND PROVIDING FOR SEVERABILITY.

A. It shall be unlawful for any peddler, solicitor, canvasser or itinerant vendor to conduct business in the City unless they comply with all registration requirements or if they are exempt from its provisions including religious, civic, or charitable solicitations.

B. Penalty not to exceed $2,000.

AN ORDINANCE AMENDING APPENDIX C OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY ADOPTED THE 19TH DAY OF NOVEMBER, 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, BY AMENDING THE REGULATION MATRIX TABLE FOR RESIDENTIAL DISTRICTS CONTAINED IN SECTION 7-Q DISTRICT AREA AND HEIGHT REGULATIONS, SUBSECTION 2,  BY AMENDING THE REGULATION MATRIX AND NOTES FOR RESIDENTIAL DISTRICTS TO CHANGE THE FRONT AND REAR YARD SETBACKS IN THE MULTI-FAMILY RESIDENTIAL – GARDEN HOME DISTRICT (MFR-GHD) AND TO SPECIFY THAT THE PARKING IS REQUIRED IN ACCORDANCE WITH THE PARKING GROUP TABLE IN THE DESIGN CRITERIA MANUAL; PROVIDING OTHER MATTERS RELATING TO THE SUBJECT; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY.

A. No lot, parcel, premises or tract of land shall be created and no building permit shall be issued for any request that does not meet the appropriate minimum lot area, width, depth, yard and height regulations as set forth in Appendix C, Section 7.Q.1. and Section 7.Q.2, Regulation Matrix.

B. It shall be unlawful to fail to comply with requirements of Regulation Matrix-Residential Districts and related notes in Section 7.Q.2

C. It shall be unlawful to fail to comply with parking requirements in Design Criteria Manual.

D. Penalty not to exceed $2,000.

INVITATION TO BIDDERS

Sealed Bids, in duplicate, addressed to COASTAL BEND PROPERTY DEVELOPMENT, LP will be received at its office at 4558 FM 2351, FRIENDSWOOD, TX 77546, until 10:00 a.m. Local Time, January 29, 2020, and then publicly opened and read for “BEAMER ROAD WATER LINE IMPROVEMENTS”, Harris County, Texas”.

Scope of Work of the Contract generally includes furnishing the necessary labor, material, equipment, incidentals, and operations and performing necessary work required for the proposed 8” water distribution system extension.

Bids received after the closing time will be returned unopened.  A MANDATORY pre-bid conference will be held on January 22, 2020, at 10:00 a.m. Local Time, at the office of COASTAL BEND PROPERTY DEVELOPMENT, LP, 4558 FM 2351, FRIENDSWOOD, TX.  Attendance by each prospective bidder or its representative at the pre-bid conference is MANDATORY, and no Bid will be opened unless the bidder or representative was present at the pre-bid conference.

Each Bid must be accompanied by a certified or cashier’s check, acceptable to the Owner, in an amount not less than 10 percent of the total amount bid, as a guarantee that the successful bidder will enter into the Contract and execute the Bonds on the forms provided and provide the required insurance certificates within 7 days after the date Contract Documents are received by the Contractor.

McHard Road Extension

Cullen Boulevard to Mykawa Road

The project will entail the construction of approximately 3.45 miles of 4-lane, divided urban roadway along McHard Road between Cullen Boulevard and Mykawa Road. This project will include the construction of a 10-foot wide shared use path, storm sewer system and detention ponds, intersection signalization, roadway lighting conduit and foundations, fiber optic conduit, landscaping and irrigation, and installation of signs and pavement markings. Other work includes site preparation, earthwork, signing and pavement markings, and other ancillary work.  The project is administered by the City of Pearland following TxDOT Local Government Project Procedures.  Contractor must adhere to all federal requirements in Form FHWA-1273, Buy America, and TxDOT’s DBE and Title VI Program as well as other federal guidelines.

A Mandatory Pre-Bid Conference will be held at the City of Pearland City Hall-Council Chambers at 3519 Liberty Drive, Pearland, Texas 77581 at 2:00 p.m. on February 4, 2020.

All bids should be submitted through the E-Bid system located on the City’s website at: https://pearland.ionwave.net/Login.aspx.  All interested Bidders are advised to register as a “supplier” on the City’s E-Bid System at the above website by clicking on “Supplier Registration” and completing a short registration questionnaire.  Electronic Bid Documents, including Plans, Technical Specifications and Bid Forms are available for download after registration is approved by City Purchasing office.  No plan fees or deposits are required for bid documents obtained through the City’s E-bid System.
