ORDINANCE NO. 91-2

AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS, ADOPTING MINIMUM STANDARDS FOR THE MAINTENANCE AND REPAIR OF SANITARY SEWER LINES ON PRIVATE PROPERTY; PROVIDING SANCTIONS FOR NONCOMPLIANCE HEREWITH, INCLUDING TERMINATION OF WATER AND/OR SEWER SERVICE; PROVIDING FOR THE FILING OF LIENS ON REAL PROPERTY UPON WHICH CHARGES ARE ASSESSED; PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION HEREOF; AND PROVIDING FOR SEVERABILITY.

A. City’s Director of Public Works or his designee shall be responsible for inspection, maintenance, repair and operation integrity of City’s sanitary sewer collection system.

B. Any person owning or occupying a tract of land upon which sanitary sewer service lines are located which flow into public lines shall be responsible for the inspection, maintenance, repair and operation integrity of such private sanitary sewer service lines.

C. It shall be unlawful for any person to fail to make necessary repairs of the private sewer service line causing infiltration or inflow, within three months of receipt of original notice of repairs by the City and shall be subject to termination of water and/or sewer service to the property.

D. The existence of infiltration or inflow into private sanitary sewer service lines is declared to constitute a nuisance and health hazard and a substandard condition pursuant to Ordinance. No. 89-26, or the Substandard Building and Structure Ordinance adopted, and if property owner or his agent refuses to make the necessary repairs, the city may initiate proceedings and following any hearing thereon may order such work done, access a charge against the owner for expenses incurred in correcting the defects and attach a lien to the effected property to secure the costs for repairs.

E. Penalty not to exceed $2,000 each day.

Fire Station # 4

The project consists of the pre-construction services and construction of a new state of the art fire station approximately 14,000 square feet intended to house one – 4 person engine crew, one – 2 person ambulance crew, 1 Shift Commander, and 1 Fire Captain -EMS.   The facility will be constructed to operate full staff on a 24/7 basis. The project will be located on an existing twelve-acre site currently owned by the City of Pearland located northeast of the intersection of Cullen Blvd. and Freedom Drive.  The station will include 10 dorm rooms, restrooms with showers, a kitchen dining area, a day room, a watch office, a treatment/PD room, offices, personnel and equipment decontamination areas, and storage areas for bunker gear and medical supplies. The facility will contain four 80-foot-deep drive through apparatus bays and the site will include secure parking for all on duty staff as well as limited number of visitor parking.  The structural envelop will be designed to 140 mph 3 second gust criteria for wind loads, a back-up generator, drive though apparatus bays with fully glazed red bi-fold doors and a bay workshop with ancillary support systems.  The project is currently approaching 10% design development stage under contract with Joiner Architects.

Shari D. Coleman Animal Shelter & Adoption Center

The project consists of the pre-construction services and construction of a new state of the art animal shelter and adoption center approximately 17,193 square feet intended to house 16 staff members, dog runs to house approximately 103 canines, and space for approximately 98 felines. The project will be located on an existing twelve-acre site currently owned by the City of Pearland located northeast of the intersection of Cullen Blvd. and Freedom Drive. Facility also includes quarantine and isolation areas in compliance with State Law, an adoption center with rooms for potential adoption interaction and observation, veterinary service room, medical suite, laundry room, and food storage areas. The project is currently approaching 10% design development stage contract with Quorum Architects, Inc.

A Mandatory Pre-Proposal Meeting will be held at the City of Pearland City Hall, 3519 Liberty Drive, Pearland, Texas 77581 in the Council Chambers at 1:00 p.m. on Thursday, February 27, 2020. This meeting is a mandatory Pre-Proposal Meeting. Attendance at this meeting is a requirement for successful submittal of a proposal for this project.

ORDINANCE NO. 2013-28

AN ORDINANCE AMENDING CHAPTER 14 OF THE CODE OF ORDINANCES OF THE CITY OF FRIENDSWOOD, ENTITLED “BUILDINGS AND BUILDING REGULATIONS,” ARTICLE VII, ENTITLED “SUBSTANDARD BUILDINGS AND STRUCTURES,” BY DELETING THE SUBJECT ARTICLE VII, IN ITS ENTIRETY, SUBSTITUTING NEW PROVISIONS IN PLACE THEREOF UNDER THE SAME TITLE UPDATING THE SUBJECT REGULATIONS AND CREATING A BUILDING AND STANDARDS COMMISSION COMMENSURATE WITH AND AS AN EXTENSION OF THE POWERS AND DUTIES OF THE BOARD OF ADJUSTMENT, PURSUANT TO CHAPTERS 54 AND 214 OF THE TEXAS LOCAL GOVERNMENT CODE; ESTABLISHING NEW PROCEDURES; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR PENALTIES IN AN AMOUNT NOT TO EXCEED $2,000.00 UNLESS OTHERWISE SPECIFIED HEREIN.

A. It shall be unlawful to violate the minimum standards for the continued use and occupancy of all types of buildings and structures within the City as adopted by this Ordinance.

B. It shall be unlawful for any building or structure to be substandard and/or unfit for human habitation and as a result, a danger to public health, safety and welfare and thus, declared to be a dangerous building or structure.

C. It is an offense for an owner or occupant or other person having control of the building, structure or property to fail to abate a public nuisance described in Sec. 14-322 and failure to abate such condition may also be prosecuted as a criminal misdemeanor offense.

D. It is an offense and unlawful for any person to cause, permit, or allow a dangerous building after the 30th day after the date on which the Building and Standards Commission finds a condition of nuisance and orders abatement, or after such extended date as may be lawfully permitted by the Building and Standards Commission.

E. The Building and Standards Commission may assess all expenses against the owner of the property and the property that was incurred by the City pursuant to the provisions of this Ordinance.

F. The Building and Standards Commission may assess and recover a civil penalty against the property owner in an amount not to exceed $1,000 per day for each violation or if the owner shows that property is owner’s lawful homestead, an amount not to exceed $10.00 per day.

G. It is unlawful for the owner, occupant, lessee(s) or manager of a building governed this Ordinance to:

1. Permit a building to be in violation of any provision of this Ordinance;

2. Permit a building to exist in a dilapidated or substandard condition or a condition unfit for human habitation and a hazard to the public health, safety and welfare;

3. Permit a building to be unoccupied or unsecured from unauthorized entry by vagrants, uninvited persons or children;

4. Permit a building that is boarded, fenced or otherwise secure to:

a. Constitute a danger to the public, or

b. Have inadequate means to secure the building from unauthorized entry or use.

5. Permit a building to be occupied only by persons who do not have a right of possession and violate any provision of this Ordinance;

6. Permit a building to exist in a dangerously damaged or deteriorated condition or in a condition likely to endanger persons or property;

7. Without authority from the code enforcement official or fire marshal to remove or destroy a placard placed on the dwelling unit by such officials; or

8. Occupy or permit a person to occupy a building or room on which the code enforcement official or fire marshal has placed a placard, absent express authorization.

H. Penalty not to exceed $2,000.

ORDINANCE NO. 83-A

AN ORDINANCE OF THE CITY OF FRIENDSWOOD, GALVESTON COUNTY, TEXAS; PROVIDING FOR INSTALLATIONS OF SEWER LINES IN CONNECTION WITH THE PUBLIC SEWER SYSTEM; REQUIRING THE CONNECTION OF WATER CLOSETS AND OTHER RECEPTACLES USED OR TO BE USED FOR THE PURPOSE OF RECEIVING AND DISCHARGING SEWAGE MATTER INTO THE PUBLIC SEWER SYSTEM; MAKING UNLAWFUL THE USE OF CESSPOOLS, SEPTIC TANKS, SEPTIC TOILETS OR PIT TOILETS UNDER CERTAIN CONDITIONS; PROVIDING OTHER UNLAWFUL ACTS PERTAINING TO USE OF THE PUBLIC SEWER SYSTEM; MAKING UNLAWFUL OBSTRUCTION OF OR DAMAGE TO THE PUBLIC SEWER SYSTEM; PROVIDING A PENALTY; PROVIDING FOR COMPLAINTS AND PROVIDING A SEVERABILITY CLAUSE.

A. Every owner of a building used for human occupancy for any time of day or night, where a main or lateral sewer of the City’s public sewer system is laid and maintained by the City within 175 feet of the tract where on such building is located or proposed, shall install within such building or part of building or upon the premises where it is situated, a water closet and shall have the same connected to City’s public sewer system. It shall be unlawful for any person or owner of a building that discharges sewage matter, waste water or slop of any kind, to fail to connect with the public sewer system of the City of Friendswood when a main or lateral sewer is within 175 feet of the tract of land.

B. It shall be unlawful for any person with a parcel of land within 175 feet from a main or lateral line of the City to use or maintain any cesspool, septic toilet, septic tank or privy vault and it shall be unlawful to connect a cesspool, septic toilet, septic tank or privy vault to the public sewer system.

C. It shall be unlawful to uncover the public sewer for any purpose or make any connection to it unless by consent or supervision of an agent of the City.

D. It shall be unlawful for owner or occupant of a building that is used for any portion of a day to fail to have at least one water closet.

E. It shall be unlawful for owner or occupant of a building in which food is cooked or clothing is washed for the public to fail to have a suitable sink or drain for reception of water.

F. It shall be unlawful to throw or allow to be thrown or deposited on the surface of the ground or in any hold or vault in or under the ground, except in the proper and necessary manuring of the soil, any liquid or solid filth, feces or urine.

G. It shall be unlawful to allow any drainings, wash or waste water of any kind to flow over the pavement, into the street or into open ditches.

H. It shall be unlawful to deposit any garbage, offal, dead animals, filth or any substance having a tendency to obstruct the flow of sewage in any manhole, flush tank or sewer opening.

I. The City is empowered to stop and prevent from discharging into the public sewer any materials which are liable to injure the sewer system or obstruct its flow or which sewer charges have not been paid by customer.

J. It shall be unlawful for any commercial or business establishment to discharge sewage effluent into the City sewage system unless s separate sewage treatment contract has been negotiated with the City.

K. It shall be unlawful for any person to obstruct, puncture, cut or injure pipes, works or drains or machinery belonging to or connected with City sewage system or to place any substance into any receptacles belonging to or connected with any sanitary sewage system of the City which may obstruct or injure the system.

L. Penalty not to exceed $2,000 each day.
