ORDINANCE NO. 2020-34

AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 14, BUILDING AND BUILDING REGULATIONS, Article viii., SWIMMING POOLS by  repealing Article Viii. sWIMMING POOLS, sections 14-356 through 14-357 And adopting chapter 14, BUILDING AND BUILDING REGULATIONS, Article viii., swimming POOLS AND SPAS, sections 14-356 AND 14-357; BY ADOPTING THE 2018 INTERNATIONAL SWIMMING POOL AND SPA Code (ispsc) ; providing a penalty of an amount not to exceed $2,000.00 for each violation; REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; publication AND AN EFFECTIVE DATE.

A. It is an offense to violate any provision of the International Swimming Pool and Spa Code, 2018 Edition, including amendments herein.

B. Penalty – a fine not to exceed $2,000

Request for Qualifications (RFQ’s) shall be submitted in duplicate, and in sealed envelopes with one (1) marked original, signed in ink along with one (1) electronic copy in form of a flash drive or CD, all clearly marked with RFQ No. 2020-16, and addressed to the City of Friendswood, Attn: Melinda Welsh, City Secretary, and they are to be received at  Friendswood City Hall, City Secretary’s Office, 910 S. Friendswood Dr., Friendswood, TX, 77546 before 2:00 pm, Thursday, October 29, 2020.

The City of Friendswood reserves the right to reject any and all RFQ’s and to waive any informality in RFQ’s received. The City of Friendswood pays for goods and services according to the provisions of Chapter 2251 of the Government Code.

Notice of 1st Public Hearing

for City of Pearland’s

Community Development Block Grant Program\

FY 2021 Action Plan and Additional COVID-19 CDBG Funding

The City of Pearland is preparing to develop and implement spending plans for three allocations of Community Development Block Grant funds issued to the City by the U.S. Department of Housing & Urban Development:

1. HUD annual allocation of $428,160 as part of the City’s regular FY 2021 entitlement jurisdiction CDBG funding;

2. CDBG Coronavirus Stimulus (CDBG-CV) allocation package #1 for $251,873 in response to COVID-19; and

3. CDBG Coronavirus Stimulus (CDBG-CV) allocation package #2 for $443,583, also in response to COVID-19.

This public hearing will initiate a 9-day comment period from October 13 – 21, 2020, for citizens and public officials to provide input, discussion and make recommendations on the City’s action plans for these allocations. The public hearing will take place via web-based videoconference on October 12, 2020 – 6:30 PM

About the Additional Funding

The U.S. Department of Housing & Urban Development (HUD) provides an annual formula allocation of funding to the City, via the CDBG program. CDBG funding is available to serve low-moderate income individuals, households and areas of the Entitlement Jurisdiction, which in the case of Pearland began in 2006 when its population exceeded 50,000. In addition, the recent White House approval of the Coronavirus Aid, Relief, and Economic Security (CARES) Act allows for the allocation of additional funds to the City of Pearland, via HUD’s issuance of a special apportionment of CDBG funds (CDBG-CV) specifically for use in response to COVID-19.

In addition to the normal allocation totaling $428,160 for the FY 2021 Pearland CDBG program, a total of $695,456 in additional CDBG funds will be made available to the City through the end of FY 2022. This public hearing will also be used to inform the public about the availability of those funds and what they may and may not be used for.

Public Hearing Participation and Comment Period

Members of the public that wish to view the public hearing and applicable Council Meeting may do so via internet at: https://pearlandtx.civicweb.net/Portal/Video.aspx. In order to speak on this item at the October 12 City Council meeting, individuals MUST submit a Speaker Request Registration Form (SRRF) and follow the applicable instructions available online at https://www.pearlandtx.gov/departments/city-secretary/speaker-request-registration-form. Instructions include the requirement that interested speakers complete the SRRF for this Public Hearing by noon (12:00 pm) on October 12, 2020.

Alternatively, citizens may view the meeting on local Municipal Access Channel 16 at the time of the meeting or do so at a later date via the City’s YouTube channel or website. Citizens may also provide input in writing via email to jhardy@pearlandtx.gov, by mail to 3519 Liberty Drive, Pearland TX 77581, hand delivery to the same address, or by telephone by contacting the Grants Administrator at 281.652.1795, October 13 – 21, 2020.

A 2nd Public Hearing (docketed) is tentatively scheduled for the October 26, 2020 Regular Meeting of City Council. Additional public input and stakeholder comments will take place at that time, and it is anticipated this will also be the date City staff recommends Council consideration and possible action on the proposed amendments.

Fair Housing Issues

The Public Hearing will also be a forum to discuss fair housing and related issues. Residents with suggestions and/or concerns will be provided opportunity to voice those issues during the public hearing. 

Notes: Requests for reasonable special accommodations or interpretive services related to Title VI, the Americans with Disabilities Act, or Section 504 of the Rehabilitation Act must be made at least 48 hours prior to this meeting to the City Secretary’s Office at (281) 652-1653.

Fair Housing

The City of Pearland promotes fair housing practices by encouraging potential homeowners or renters to be aware of their rights under the Fair Housing Act.  Title VIII of the Civil Rights Act of 1968, as amended, prohibits discrimination against any person on the basis of race, color, religion, sex, disability, familial status or national origin in the sale or rental of units in the housing market.

Policy of Non-Discrimination Based on Disability

The City of Pearland, TX does not discriminate based on disability in the admission or access to, or employment in, its federally assisted programs or activities.  The City has a Title VI policy and plan, and has a designated official to coordinate compliance with the nondiscrimination requirements contained in the Housing and Urban Development’s (HUD) regulations which implements Section 504 (24 CFR Part 8).

Citizen Participation & Grievance Procedures Notice

The City of Pearland has proposed complaint and grievance procedures regarding its Community Development Block Grant – Disaster Recovery Programs (CDBG-DR).  Citizens may obtain a copy of complaints with the City of Pearland – City Secretary’s Office within fifteen (15) business days where applicable.

Notice to Section 3 Residents and Business Interests

The City of Pearland has received Community Development Block Grant – Disaster Recovery (CDBG-DR) funding for an infrastructure project.  Businesses may be designated as Section 3 eligible if 51% or more of the business is owned by Section 3 Residents, at least 30% of permanent full-time employees are or have been Section 3 Residents in the past three (3) years or if the business commits to subcontract in excess of 25% of dollar award of all subcontracts to Section 3 business concern.  The City of Pearland shall notify registered Section 3 Residents and Business Interests of employment and contracting opportunities related to CDBG-DR funded projects.  Registration and detailed information will be made available at the City of Pearland website: www.pearlandtx.gov.

Public Comment

Citizens may provide comments on the development and implementation of these policies and procedures through November 6, 2020.
