Final Notice and Public Explanation of a Proposed 

Activity in a Wetland/100-Year Floodplain

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Brookside Village. To: All interested Agencies, Groups and Individuals on 7/22/2020:  This is to give notice that the City of Brookside Village has conducted an evaluation as required by Executive Order 11988 and 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under the Community Development Block Grant Program under contract 20-065-037-C118. The City proposes to repair and reconstruct approximately 11,120 linear feet (LF) of driving surface, sub-grade, and road base by milling, applying asphalt, and stripping of streets with incidental repairs to roadside ditches and completion of associated appurtenances. All work will be performed at the following locations: on Woody Rd from approximately 70 LF south of Brookside Rd to a point approximately 210 LF north of its intersection with Cleo St, on Isla Street from Woody Rd to Mykawa Rd, on Lila Street from Woody Rd to Mykawa Rd, on April St from approximately 70 LF south of Brookside Rd to Isla Rd, on Katy Street from Mykawa Rd to a point approximately 225 LF west of February St, and on Ella St from Woody Rd to Mykawa Rd, Brookside Village, Brazoria County, Texas. If funds allow, work will continue on Lesiker St from Woody Rd to a point approximately 860 LF to the west. The project shall include activities within approximately 3.98 acres of the 100-year floodplain and .02 acres of wetland.  The City of Brookside Village has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values: a reduction in scope, alternate locations, and no action.  The scope and location of project activities were chosen based on minimum improvements necessary to correct the health and safety risks existing facilities pose to the natural and human environment.  Additionally, there shall be no significant increase to impervious surface, best management practices shall be employed during construction to ensure erosion control and to prevent the unintentional discharge of dredged or fill material into the wetland, and the activity shall comply with state and local floodplain management/wetlands protection procedures.  The City of Brookside Village has reevaluated the alternatives to building in the floodplain/wetland and has determined that it has no practicable alternative.  Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 and 11990 are available for public inspection, review, and copying upon request during regular business hours at the City Hall. There are three primary purposes for this notice: (1) People who may be affected by activities in floodplains/wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas; (2) An adequate public notice program can be an important public educational tool.  The dissemination of information and request for public comment about floodplains/wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas; and (3) As a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains/wetlands, it must inform those who may be put at greater or continued risk.  Written comments must be received on or before 7/29/2020 by the City of Brookside Village at 6243 Brookside Rd, Brookside Village, TX 77581, (281) 485-3048.
